§ 1. Provider and contact details
- The provider and owner of the Digestory mobile app is:

hereinafter referred to as the "Provider". - These Terms of Service set out the rules for providing electronic services through the Digestory mobile app, the rules for creating and maintaining an Account, the rights and obligations of Users, and the rules of liability and complaints handling.
- These Terms are made available free of charge before an Account is created, in a way that allows them to be saved and reproduced. The current version of these Terms is available in the App and at digestory.pl.

§ 2. Definitions
For the purposes of these Terms, the following terms mean:
- App or Digestory — the Digestory mobile app intended for self-tracking a journal of symptoms, meals, habits, and other information related to health and lifestyle.
- Account — an individual User profile created in the App.
- User — a natural person using the App.
- Consumer — a User who is a consumer under applicable law.
- User Data — data and content entered by the User into the App, including journal entries, notes, answers to prompts, settings, and other information saved to the Account.
- AI Features — features using artificial intelligence systems, in particular to recognize and organize entries, look for possible patterns, and generate summaries or suggestions.
- Store — the Apple App Store or Google Play, as applicable, through which the App is downloaded or through which payments may be made.
§ 3. Nature and features of the App
- Digestory is a tool intended for self-documenting and observing information about wellbeing, digestive symptoms, meals, bowel movements, sleep, stress, activity, medication, supplements, hydration, body weight, and other factors indicated by the User.
- Depending on the current version, the App may enable, among other things:
- manually adding journal entries;
- adding entries by text or dictation;
- automatic organization of entries using the "Add your Digestory" feature;
- displaying charts, summaries, and possible correlations;
- generating summaries and reports;
- setting reminders and notifications;
- assigning specific actions to NFC tags;
- exporting information so the User can share it themselves with a chosen person, for example a doctor or dietitian.
- The availability of individual features may depend on the operating system version, device type, granted permissions, the User's country, and the plan held.
- The User decides for themselves what information to record in the App and with whom to share generated reports.
- The Provider does not share reports with a doctor, dietitian, or other person without the User's action and instruction.
§ 4. Digestory is not a healthcare service or a medical device
- Consistent with its stated purpose, Digestory is an app that supports self-tracking a journal and observing one's lifestyle. It is not intended for use as a medical device.
- The App is not intended to:
- diagnose diseases, disorders, or intolerances;
- confirm or rule out a medical diagnosis;
- treat, alleviate, or prevent disease;
- determine dosing of medication or supplements;
- assess the urgency of symptoms or perform medical triage;
- make clinical decisions;
- replace an examination, consultation, or recommendation from a doctor, dietitian, psychologist, or other specialist.
- Information, patterns, correlations, suggestions, and summaries displayed by the App are informational and supplementary in nature. They may be incomplete, outdated, or inaccurate.
- A correlation shown does not mean a causal relationship and does not confirm that a specific product, behavior, or event caused a symptom.
- The User should not start, change, or stop treatment, an elimination diet, or medication based on information displayed by the App.
- In the event of severe, sudden, or concerning symptoms, the User should contact a doctor or the appropriate emergency services. Digestory is not an emergency service and does not monitor entries in real time.
- Using the App does not create a doctor–patient relationship or any other professional relationship between the User and the Provider.
§ 5. Technical requirements
- Proper use of the App requires:
- a compatible mobile device;
- iOS or Android running a version currently supported by the manufacturer;
- internet access;
- an active email address;
- an up-to-date installed version of the App.
- Some features may require granting the App permission to access the microphone, notifications, or NFC. Granting these permissions is voluntary, but not doing so may prevent the use of the relevant feature.
- The User bears the cost of data transmission and device use under their agreement with their network operator or internet provider.
- The User should keep their software up to date, secure their device against access by third parties, and not share their login credentials with anyone else.
§ 6. Conclusion of the contract and the Account
- The contract for the provision of electronic services is concluded upon:
- accepting these Terms;
- creating an Account; and
- activating the Account, if activation is required.
- The Privacy Policy is informational in nature. Reading it does not replace the consents required for health data, AI Features, the microphone, or notifications.
- Creating an Account requires providing an active email address and a password.
- The User is obligated to:
- use an email address they are entitled to access;
- keep their login credentials secure;
- promptly notify the Provider of any suspected compromise of their Account;
- not share their Account with other people.
- Each Account is intended for use by one person. The App should not be used to systematically maintain health records for other people.
- The App may be used by people who are at least 16 years old.
- A person under 16 may not independently create an Account or provide health data. The Provider may take proportionate steps to verify a User's age.
- If the Provider obtains credible information that an Account belongs to a person below the required age, it may block the Account and delete the related data, unless processing may lawfully continue on the basis of a verified consent from a legal guardian.
§ 7. Health data and User consents
- Some of the information entered into Digestory may constitute health data or other special category data.
- Processing health data requires the User's explicit consent, given separately from acceptance of these Terms.
- Consent may not be pre-ticked. The Provider records the content of the consent, the date, and the manner in which it was given.
- The User may withdraw consent at any time in the Account settings or by contacting the Provider.
- Withdrawing consent to process health data may prevent further use of Digestory's core features. Before withdrawing consent, the User should be able to download their data, unless a legal exception applies.
- Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.
§ 8. AI-powered features
- Digestory may use artificial intelligence systems provided by third-party vendors, in particular OpenAI and Anthropic, depending on the current technical configuration.
- AI Features may be used, among other things, to:
- recognize the meaning of a text entry;
- organize an entry and assign information to the relevant fields;
- create summaries;
- compare entries across different periods;
- identify possible relationships, changes, or patterns.
- Before content containing personal data or health data is first sent to a third-party AI provider, the User will receive clear information about:
- the type of data transferred;
- the purpose of the transfer;
- the provider or category of providers;
- the possibility of data being processed outside the European Economic Area;
- the voluntary nature of using the feature.
- Data is sent to an external AI system only after the User has given separate, explicit consent.
- Declining or withdrawing consent to use AI Features should not deprive the User of the ability to keep the journal manually, as long as manual journaling remains available in that version of the App.
- AI responses and outputs may contain errors, simplifications, inaccuracies, or content that does not fit the User's situation. The User should verify them independently and may correct an automatically structured entry.
- Digestory informs the User when content, a suggestion, or a summary has been generated or materially processed by AI.
- AI Features do not make decisions about the User that produce legal effects or similarly significantly affect them.
- The Provider does not use User entries to train its own general AI models, unless the User has been clearly informed of this in advance and has given separate consent. In the current version of the App, no such use is planned.
§ 9. Rules of use
- The User is obligated to use the App in accordance with the law, these Terms, its intended purpose, and generally accepted standards of conduct.
- In particular, it is prohibited to:
- attempt unauthorized access to other Users' Accounts, infrastructure, or databases;
- circumvent security measures or technical limits;
- disrupt the App's operation or place excessive load on its infrastructure;
- introduce malicious code or automatically query the App without consent;
- use the App to infringe the rights of others;
- enter another person's personal data or health information without an appropriate legal basis and their knowledge;
- use AI Features to generate content unrelated to Digestory's functionality;
- use the App as an emergency, diagnostic system, or one used to make clinical decisions.
- The User is responsible for the content they enter into the App and for the lawfulness of entering it.
§ 10. Rights to the User's data and content
- The User retains rights to the data and content they enter.
- The User grants the Provider a limited, non-exclusive, royalty-free right to technically store, copy, process, and display that content, solely to the extent necessary to:
- provide the App's features;
- carry out the User's instructions;
- ensure the security and continuity of the service;
- fulfill legal obligations.
- The right referred to above does not allow the Provider to sell the User's data, use health data for advertising, or train general AI models without a separate legal basis.
§ 11. Fees, subscriptions, and purchases
- The App is currently offered on a free basis, with no fees or subscriptions.
- If paid features are introduced in the future, the scope of free and paid features, the price, the billing period, trial-period rules, and the terms of automatic renewal will be presented to the User before purchase.
- Any payments made in the App may be handled by the Apple App Store or Google Play. The Provider generally does not receive the User's full payment card details.
- Any subscriptions may renew automatically until the User cancels them under the rules of the relevant Store.
- Deleting a Digestory Account does not automatically cancel an active subscription in the Apple App Store or Google Play. The User should separately cancel their subscription in the settings of the relevant Store.
- Refund rules for payments made through a Store may be further defined by Apple's or Google's terms. This does not limit the Consumer's mandatory statutory rights.
- The Provider will not introduce a paid feature or new subscription without disclosing its price and obtaining the User's explicit consent to purchase.
§ 12. Availability, maintenance, and updates
- The Provider exercises reasonable care to keep the App available and working correctly, but does not guarantee uninterrupted or entirely error-free operation.
- Availability of the App may be temporarily limited due to:
- maintenance work;
- updates;
- outages;
- security threats;
- third-party providers' actions;
- events beyond the Provider's reasonable control.
- Where possible, planned downtime will be communicated in advance.
- The User should install updates necessary to ensure the security, compliance, and proper operation of the App.
- The Provider may develop, change, or remove App features. Changes affecting Consumers will be made in accordance with mandatory digital-services law.
- Updates necessary to keep the digital service compliant with the contract will be made available for the period required by law.
§ 13. Conformity of the digital service and complaints
- The Provider is liable to the Consumer for the conformity of the digital service with the contract on the terms set out in mandatory law.
- Complaints about the App's operation may be submitted:
- by email to kontakt@digestory.pl;
- in writing to: ul. Jedności 3, 43-245 Studzionka, Poland;
- via the contact feature available in the App, if provided.
- A complaint should include, in particular:
- information identifying the Account;
- a description of the problem;
- the date it occurred;
- the operating system and App version used;
- the expected way the complaint should be resolved.
- Providing the above information is not a condition for handling a complaint if it can be resolved on the basis of other data.
- The Provider will respond to a Consumer's complaint within 14 days of receiving it.
- In the event of a non-conformity of the digital service with the contract, the Consumer is entitled to the remedies available under applicable law, including bringing the service into conformity and, where appropriate, a price reduction or termination of the contract.
- These Terms do not limit any statutory rights of the Consumer.
§ 14. Right of withdrawal
- A Consumer who enters into a distance contract may generally withdraw from it within 14 days, subject to the exceptions provided by law.
- A withdrawal statement may be sent to kontakt@digestory.pl. The Consumer may use their own unambiguous statement.
- Regardless of the right of withdrawal, the User may stop using the App and delete their Account at any time.
- For a payment handled by Apple or Google, a refund may also be processed through the relevant Store, in accordance with its procedures and applicable law.
§ 15. Liability
- The Provider is liable on the terms provided by applicable law. These Terms do not exclude or limit liability that cannot lawfully be excluded or limited.
- The Provider is not liable for the consequences of treating informational content, correlations, or AI outputs as a diagnosis, therapeutic recommendation, or medical advice, provided the App clearly disclosed their supplementary nature.
- The User is responsible for their decision to share a report, entries, or other information with third parties.
- The Provider is not liable for problems arising solely from:
- an incompatible or unsecured device;
- an outdated version of the App or operating system;
- the User's loss of their login credentials;
- the actions of a telecommunications operator or internet provider;
- the User's interference with the App's code or security.
- To the extent permitted by law, the Provider is not liable for the operation of third-party services beyond its control; this does not affect the Provider's liability for properly selecting its providers and protecting the data entrusted to them.
§ 16. Suspension and deletion of the Account
- The User may delete their Account at any time:
- directly in the App's settings; or
- by contacting the Provider at kontakt@digestory.pl.
- Deleting the Account starts the process of deleting or anonymizing data in accordance with the Privacy Policy.
- The Provider may temporarily suspend an Account where necessary to:
- protect the Account or other Users;
- investigate a suspected security breach;
- limit abuse;
- fulfill a legal obligation.
- The Provider may terminate the contract in the event of a material or repeated breach of these Terms. Where circumstances allow, the User will first be asked to stop the breach.
- The Provider may discontinue the App, informing Users with reasonable advance notice and allowing them to download their data, unless immediate termination is required by law or necessary for security reasons.
§ 17. Intellectual property
- Rights to the App, its code, design, graphics, databases, marks, the Digestory name and logo belong to the Provider or its licensors, as applicable.
- The User receives a limited, non-exclusive, non-transferable, and revocable right to use the App for their own personal use, in accordance with these Terms.
- Without the Provider's prior consent, it is prohibited to copy, modify, distribute, decompile, or commercially exploit the App, except as permitted by mandatory law.
- These Terms do not transfer to the Provider any rights to original content entered by the User.
§ 18. Apple App Store and Google Play
- The App may be distributed through the Apple App Store and Google Play.
- Use of a Store, downloading the App, and handling payments are also subject to the terms of the relevant Store operator.
- Apple and Google are not the provider of Digestory and are not liable for account features, journaling, or content generated by the App.
- For the iOS version, if the Provider does not make a separate license agreement available in App Store Connect, Apple's standard end-user license agreement applies.
- These Terms do not limit any rights a User may have against Apple or Google under their agreement with the relevant Store.
§ 19. Changes to these Terms
- These Terms may be changed for valid reasons, in particular in the event of:
- a change in the law or in Apple's or Google's requirements;
- the introduction of new features;
- a change in how the service is provided;
- the need to improve security;
- a change in the pricing model;
- a change in the Provider's details.
- The User will be notified of material changes via the App, email, or the website at least 14 days before they take effect, unless a shorter period is required by law or for security reasons.
- Changes that do not require the User's consent do not affect any rights already acquired.
- If a change materially and negatively affects the User's access to or use of the digital service, the User is entitled to the remedies provided by applicable law.
§ 20. Governing law and disputes
- These Terms are governed by Polish law.
- The choice of Polish law does not deprive a Consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.
- Disputes with Consumers will be resolved by the courts having jurisdiction under applicable law.
- A Consumer may use available out-of-court methods for handling complaints and pursuing claims, in accordance with the rules of the relevant consumer institutions.
§ 21. Final provisions
- If any provision of these Terms is found to be invalid, this does not affect the validity of the remaining provisions.
- The Privacy Policy is a separate document describing the rules for processing personal data.
- These Terms apply from the date indicated at the beginning of this document.
